Each of these departments is operationally independent, and each has their own staff under the supervision of a department Director.</p><br /> <p style="text-align: justify;">&nbsp;</p><br /> <p style="text-align: justify;"><strong>National Preventive Mechanism</strong></p><br /> <p style="text-align: justify;">The Optional Protocol to the Convention against Torture (<span class="caps">OPCAT</span>) ratified by the Maldives on 15 February 2006 obliges each State party to \&#8220;maintain, designate or establish &#8230;.. one or several independent national preventive mechanisms for the prevention of torture at the domestic level\&#8221;.</p><br /> <p style="text-align: justify;">Under this the government has taken the decision to appoint the Human Rights Commission of the Maldives (<span class="caps">HRCM</span>) as the National preventive mechanism (<span class="caps">NPM</span>) under the <span class="caps">OPCAT</span> On 28th April 2008 the <span class="caps">HRCM</span> appointed staff for the <span class="caps">NPM</span> and has begun fulfilling the country\&#8216;s obligations under <span class="caps">OPCAT</span>.</p><br /> <p style="text-align: justify;">&nbsp;</p><br /> <p style="text-align: justify;"><strong>The detention monitoring medical advisors duties and responsibilities are:</strong></p><br /> <p style="text-align: justify;">1. Analyze all conditions of the detention and other places where people are detained from a medical perspective, including environmental factors (protection from the climate, ventilation, access to the open air, etc.), overcrowding, water and sanitation. general hygiene, food and nutrition and outbreaks of diseases in order to prevent all conditions and circumstances that might have a direct or an indirect effect on the health of the detained population.</p><br /> <p style="text-align: justify;">2. Evaluate and make recommendations on the general health care services provided in all places of detention in the Maldives, in particular through examination and analysis of the medical records of persons held in places of detention and by conducting interviews with medical staff of the detention facilities.</p><br /> <p style="text-align: justify;">3. Advice on issues of medical standards and medical services relevant to the places of detention.</p><br /> <p style="text-align: justify;">4. Undertake preparatory work prior to the visit such as collecting information of the place of detention and organizing work within the visiting team. Collect any relevant information regarding medical standards and organization of the medical services.</p><br /> <p style="text-align: justify;">5. In cases of allegations of torture and ill treatment conduct private medical examinations of the detainees in order to assess whether alleged physical or psychological are consistent with the allegations made by the complainant.</p><br /> <p style="text-align: justify;">6. Actively take part in the preventive visits as a member of the <span class="caps">NPM</span> visiting team to places of detention in the Maldives.</p><br /> <p style="text-align: justify;">7. Assist in the reporting of monitoring reports to the relevant authorities and to the general media by submitting the finding. observations and recommendations in written form.</p><br /> <p style="text-align: justify;">8. Conduct basic training for the <span class="caps">NPM</span> and the Commission about general or specific medical issues in places of detention (drugs, <span class="caps">HIV</span>, <span class="caps">PTSD</span>) syndrome and other such issues.).</p><br /> <p style="text-align: justify;">&nbsp;</p><br /> <p style="text-align: justify;">Both advisors are placed in the <span class="caps">NPM</span> unit of the <span class="caps">HRCM</span> which consists of 4 staff. The main purpose of the <span class="caps">NPM</span> is to establish a system of regular visits to places where persons are deprived of liberty in order to analyze treatment, condition and administration. Based on the information attained from these preventive visits and its legal and other analysis, <span class="caps">NPM</span> would then make recommendations for further strengthening the protections given to persons held in those places in accordance with the international standards. The advisors would be involved in every stage of these monitoring visits (from the preliminary preparation of visit, monitoring. report writing to follow up on the visit and its recommendations)</p><br /> <p style="text-align: justify;">&nbsp;</p><br /> <p style="text-align: justify;"><strong>The detention monitoring legal advisors duties and responsibilities are:</strong></p><br /> <p style="text-align: justify;">1.
